Introduction

This Privacy Policy describes the data protection practices of FaroRx and its affiliates, including FaroRx (“we”, “our”, or “us”), when you visit any FaroRx website that links to this Privacy Policy (including farorx.com), use any affiliated mobile application, or otherwise provide data to us. We refer to these together as the “Services.” This Privacy Policy is incorporated into our Terms & Conditions.

Please read this Privacy Policy carefully to understand how we handle your information. If you do not agree to it, please do not use the Services.

Protected Health Information handled by our affiliated medical providers is also governed by our HIPAA Notice of Privacy Practices.

The Information We Collect and Its Sources

Information you provide to us. We collect information through account registration and administration, processing your orders and treatment requests, questions or feedback you submit, participation in research and surveys, customer support and technical assistance requests, content you upload or post, and employment applications. Depending on the Services you use, this may include your name, address, telephone number, date of birth, and email address; information about your medical conditions, treatment options, provider referrals, prescriptions, and related health information; login credentials; billing information collected by our payment processors; purchase and transaction history; customer service interactions; demographic information such as gender and age; and any other information you choose to provide.

Information collected automatically. When you use the Services, we and our service providers collect information such as your IP address, browser type and language, operating system, device identifiers, referring and exit pages, platform type, pages viewed and the order of those pages, time spent on pages, search terms, files downloaded, error logs, and dates and times of use. On mobile, we may also collect device identifiers, carrier and browser information, and how you use the application.

Location information. We may collect general location information (such as the city, state, or postal code associated with an IP address) to deliver location-relevant content and accurate tax information. We will ask your permission before collecting precise GPS location, and you can disable location features in your device settings at any time.

Cookies and similar technologies. We and our service providers use web server logs, cookies, tags, SDKs, tracking pixels, and similar technologies to recognize your device, store preferences, understand which parts of the Services you use, measure content and advertising effectiveness, perform analytics, and support security and administrative functions. You can configure your browser to notify you about cookies or block them entirely, though some features may not work as a result.

Social media. When you follow or interact with us on social platforms, or sign up for a promotion there, we may collect your name, email address, and any content you post that relates to us.

Other sources. We work with third parties — including physicians, medical professionals, and pharmacies who provide health care services, technical subcontractors, advertising networks, analytics providers, and search information providers — who may provide us with additional information about you.

How We Use Your Information

• Operate, improve, and manage the Services, and facilitate the provision of health care services by licensed providers.
• Conduct internal research to understand and improve the effectiveness of the Services; published results are presented in de-identified, aggregate form.
• Communicate with you about the Services, your use of them, and inquiries you submit, including messages sent on behalf of your provider.
• Send you information about surveys, promotions, events, products, and services, where permitted.
• Provide technical support and customer service.
• Verify your identity, administer your account, process payments, and fulfill orders.
• Present content effectively for your device, enable interactive features, and keep the Services safe and secure.
• Measure and customize advertising and content.
• Comply with applicable laws and regulations, and establish, exercise, or defend legal rights.

We may combine information collected through the Services with information from other sources, and may aggregate or de-identify information so that it can no longer be linked to you or your device. Aggregated and de-identified information may be used and shared for any purpose.

Online Analytics and Advertising

We use third-party web analytics services to collect and analyze usage information through cookies and similar tools, support auditing and reporting, assist with fraud prevention, and improve features. If you receive email from us, we may use analytics tools to measure opens and clicks so we can gauge the effectiveness of our communications.

The Services may integrate third-party advertising technologies that use cookies and similar technologies to deliver relevant content and advertising on our Services and on other sites and applications you use. These ads may be based on your current activity or on activity over time and across other online services. We may also provide information such as email addresses to service providers who match it in de-identified form to advertising identifiers.

We do not control, and this Privacy Policy does not govern, cookies or tracking technologies placed by unaffiliated advertising networks. To learn about and opt out of interest-based advertising, visit the Network Advertising Initiative and the Digital Advertising Alliance consumer opt-out tools. Opting out does not stop advertising; it stops it from being tailored to you.

Do Not Track. We provide the opt-out mechanisms described above, but we do not currently respond to browser-initiated Do Not Track signals.

How We Share and Disclose Your Information

• Affiliates and subsidiaries — to deliver products and services and maintain a consistent customer experience.
• Health care providers and pharmacies — to schedule and fulfill visits, deliver messages you send, and support treatment, payment, and health care operations, including prescription fulfillment.
• Service providers — billing, sales, marketing, advertising, analytics, research, customer service, shipping and fulfillment, data storage, IT and security, fraud prevention, payment processing, auditing, and legal services.
• Legal and protection purposes — to comply with legal process, enforce our agreements, respond to claims, respond to customer service requests, or protect the rights, property, or safety of our company, our users, and the public.
• Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to applicable law.
• Public forums — content you post publicly, such as reviews, is not confidential and may be displayed on our sites and third-party sites.
• With your consent — in other ways you direct us to.
• Aggregated or de-identified information — at our discretion.

Your Marketing Choices

You may ask us not to contact you by email, postal mail, or phone about products, services, promotions, and special events by contacting us using the details below, or by following the unsubscribe instructions in our marketing emails. You may not opt out of operational messages that relate to your account, orders, or care.

Third Party Services and Health Information

This Privacy Policy does not cover, and we are not responsible for, the privacy or security practices of third parties, including physicians and other health care providers using the Services, device and software manufacturers, and any third-party website or application linked from our Services. We encourage you to review their privacy and security policies.

How We Protect Your Information

We take technical and organizational security measures to protect your information against accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access. However, no method of transmission or storage is completely secure, so we cannot guarantee the security of information transmitted to or through the Services.

If you have an account, you are responsible for keeping your password confidential. Please do not share it with anyone.

Privacy Information for California Residents

California law requires us to describe the categories of personal information we collect and the categories of third parties to which we disclose it. Some information collected through the Services, such as medical information, is subject to health data privacy laws rather than the California Consumer Privacy Act (CCPA).

The categories we collect include identifiers and contact information; commercial and transactional information; financial information collected by our payment processors; internet, network, and device activity; geolocation information; demographic and statistical data; physical characteristics such as photos you provide; user-generated content; and customer service data. We disclose these categories to service providers, our affiliates, health care providers and pharmacies, payment processors, and entities involved in legal compliance and fraud prevention.

California residents may request that we disclose the categories and specific pieces of personal information we collect, provide access to or a copy of that information, and delete certain information. You will not be discriminated against for exercising these rights. We may need to verify your identity, and some information is exempt from these requests. To submit a request, email info@farorx.com with your full name, email address, and the residential address associated with your use of the Services.

Sale of personal information. We do not sell information that identifies you, such as your name, email address, phone number, or postal address. Because of the broad definitions in the CCPA, making online identifiers available to advertising partners may be considered a “sale”; you can opt out using the industry opt-out tools linked above. These opt-outs are device and browser specific.

Shine the Light. We do not share personal information with third parties for their own direct marketing purposes.

Privacy Information for Nevada Residents

Nevada law allows certain consumers to opt out of the sale of personally identifiable information for monetary consideration. We do not engage in such sales, but Nevada residents who have purchased services from us may submit an opt-out request by emailing info@farorx.com. We will take reasonable steps to verify your identity and will retain your request in the event our practices change.

Retention of Your Information

We retain patient medical records for a minimum of seven (7) years following the patient's last date of service, or longer when required by applicable federal or state law, contractual obligations, or a legal hold.

When we no longer serve a patient, their Protected Health Information remains securely archived and protected by appropriate administrative, technical, and physical safeguards. Access is limited to authorized personnel, and the information is used or disclosed only as permitted or required by law, including for patient access requests, continuity of care, billing, audits, and regulatory or legal obligations. We do not sell former patients' PHI and we do not use it for unrelated marketing.

After the applicable retention period expires, and provided no legal or regulatory hold applies, records are securely destroyed or permanently de-identified in accordance with our records-retention and disposal procedures. Any service providers handling PHI remain subject to applicable confidentiality, security, and Business Associate Agreement requirements.

Revisions to Our Privacy Policy

We may change this Privacy Policy at any time to reflect changes in the law, our practices, the features of our Services, or advances in technology. The revised policy will be posted here with an updated date, and material changes will be accompanied by appropriate notice. Your continued use of the Services after those changes constitutes acknowledgement of them.
